Terms of Use

These Terms of Use ("Terms") are an agreement between you and Vincere ("Vincere", "we", "our", or "us") and govern your use of the Vincere iPhone app, Apple Watch app, widgets, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Vincere.

1. Who Can Use Vincere

You must be at least 13 years old (or the minimum age in your country) to use Vincere. If you're under 18, you need permission from a parent or guardian. You're responsible for your account, for keeping your sign-in secure, and for everything that happens under it.

2. The Service

Vincere helps you plan and track tasks, habits, and goals, share them with people who keep you accountable, and get coaching from Vince, an AI coach. We're constantly improving Vincere, so features may change, be added, or be removed.

3. Your Content

You own what you create in Vincere — your tasks, habits, notes, photos, posts, and messages ("Your Content"). To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, process, and display Your Content only as needed to operate Vincere and only to the people you choose to share it with. This licence ends when you delete the content or your account, except where others have already received it (for example, a task you shared with them) or the law requires us to keep it.

You're responsible for Your Content and confirm you have the right to share it.

4. Community Rules — Zero Tolerance

Vincere has zero tolerance for objectionable content or abusive users. You agree not to post, share, or send content that:

• Harasses, bullies, threatens, or intimidates anyone
• Is hateful or discriminatory, or promotes violence
• Is sexually explicit, or sexualises minors in any way
• Encourages self-harm, eating disorders, or dangerous activity
• Is illegal, infringes someone else's rights, or shares someone's private information without consent
• Is spam, a scam, or impersonates someone

You can report content or users and block anyone from inside the app. We review reports and act on them within 24 hours, which may include removing content and suspending or banning the person who posted it.

5. Sharing & Accountability

When you share or assign a task or habit, the people you share it with can see it and its progress, and may receive notifications about it. The person who created a shared task controls it. Only share with people you trust, and respect others' privacy — don't screenshot or repost what others share with you without their permission.

6. Vince, the AI Coach

Vince's replies are generated by AI and can be inaccurate, incomplete, or wrong. Vince is a productivity coach, not a doctor, therapist, dietitian, financial adviser, or lawyer, and nothing Vince says is professional advice. Use your own judgement, and talk to a qualified professional about health, mental-health, financial, or legal decisions. If you are in crisis or danger, contact local emergency services.

7. Health & App Blocker

Vincere is not a medical device and isn't meant to diagnose, treat, or prevent any condition. Health information is shown for motivation only. The App Blocker uses Apple's Screen Time and may not block every app or website in every situation.

8. Subscriptions & Payment

Vincere is free to download. Some features require a paid subscription (Vincere Premium).

• Payment is charged to your Apple ID account when you confirm your purchase.
• Subscriptions automatically renew at the same price and length unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in iPhone Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you've paid for.
• If a free trial is offered, any unused part of it ends when you buy a subscription.
• Refunds are handled by Apple under the App Store's policies. You can request one at reportaproblem.apple.com.
• Prices are shown in the app before you buy and may vary by country.

9. Acceptable Use

You agree not to:

• Use Vincere for anything illegal
• Try to access other people's accounts or data, or our systems, without permission
• Reverse engineer, scrape, or copy the Service, or use bots to access it
• Game or manipulate W's, streaks, rankings, or rewards
• Interfere with or disrupt the Service or other users
• Upload viruses or other harmful code

10. Our Intellectual Property

Vincere, its name, logo, design, characters (including Vince), and software belong to us and are protected by law. These Terms don't give you any right to use them except to use the Service as intended.

11. Ending Your Account

You can stop using Vincere and delete your account at any time in Settings → Account → Delete Account. Deleting your account doesn't cancel an App Store subscription — cancel that in your iPhone Settings. We may suspend or end your access if you break these Terms, create risk for other users, or if required by law.

12. Disclaimers

Vincere is provided "as is" and "as available", without warranties of any kind, to the fullest extent allowed by law. We don't promise the Service will always be available, error-free, or that data will never be lost — though we work hard to make sure it is.

13. Limitation of Liability

To the fullest extent allowed by law, Vincere won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

14. Apple App Store Terms

If you downloaded Vincere from Apple's App Store, you also agree that:

• These Terms are between you and Vincere only, not Apple. Vincere, not Apple, is responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store's Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the app.
• Vincere, not Apple, is responsible for handling any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, and intellectual-property claims.
• You confirm you are not located in a country subject to a U.S. government embargo, and are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Where these Terms are silent, Apple's Standard Licensed Application End User License Agreement applies.

15. Changes to These Terms

We may update these Terms as Vincere evolves. We'll update the "Last updated" date above, and for significant changes we'll let you know in the app. If you keep using Vincere after changes take effect, you accept the updated Terms.
